Terms of use
The rules for using the Gotu app and gotu-app.com.
This is a translation. If the English and the Dutch text differ, the Dutch version prevails.
1. The service
Gotu app (Gotu, "Gotu") shows offers from participating hospitality venues ("venues"). In the Gotu app you reserve an available deal for a visit date and redeem it on the spot; the staff process this by entering your 4-character code. Gotu is not a party to what you buy or eat at a venue: you pay at the venue. Gotu does not take payment for a deal in the app.
Reserving, redeeming, cancelling and Gotu credit are also governed by the deal terms. How we handle your data is described in the privacy policy.
2. Only for people aged 18 and over
Gotu is meant for people aged 18 and over, because deals can include alcohol. When you create your account we ask for your date of birth to show age-appropriate deals; venues never see that date. Venues do not serve alcohol to people under 18 and may ask for ID.
3. Your account
Use your own account and keep your sign-in method safe. Your account is personal: deals, favourites, rewards and Gotu credit are linked to that account and cannot be transferred. You can delete your account at any time in the app or via the website.
4. Use and misuse
You use Gotu honestly and for yourself. It is not allowed to:
- create multiple accounts, or invite yourself or an acquaintance to earn invitation credit;
- reserve or redeem deals without using them, or guess, share or have codes of other guests entered remotely;
- disrupt or bypass the app, its security or its operation, or collect other people's data;
- make false or misleading reports.
If we suspect misuse we can declare credit or a redemption invalid, temporarily block reserving, or close an account. You can object via support@gotu-app.com. To detect misuse we use the signals listed in the privacy policy.
5. Availability and liability
Offers, opening hours and quantities come from the venues and can change; the conditions on the deal page apply as they were when you reserved. We do our best to keep Gotu available and safe, but cannot guarantee uninterrupted operation.
Gotu is not liable for what a venue provides or fails to provide, for the quality of food and drink, or for damage caused by an interruption of the service, except in the case of intent or deliberate recklessness on Gotu's part. This does not affect statutory consumer rights.
6. Role of Gotu and the venue's responsibility
Gotu helps you find deals, rewards and subscriptions from venues, and records what you reserve, collect and claim. The venue itself delivers: the food and drink, the welcome and whatever it promised you. Gotu plays no part in that and cannot check it.
The venue is responsible for:
- opening hours and closed days: if the venue is closed or open differently from what the app shows, the venue sorts that out with you;
- what the venue tells you about its menu, prices, availability, conditions and allergens. Do you have an allergy? Always ask the staff;
- the quality and safety of food, drink and service;
- honouring your deal, reward or subscription, also if the staff refuse it or process it wrongly;
- complaints, refunds and compensation for what you bought or received at the venue. For those you go to the venue.
To the extent the law permits, Gotu is not liable for these things. If you cannot resolve it with the venue, also report it via Help in the app or to support@gotu-app.com; we can look at what was recorded, but the venue remains responsible.
Gotu is responsible for its own technology. If something goes wrong because of Gotu's app or systems (the app or server is down, a code does not work when it should, or a deal, stamp, credit, claim or term is registered wrongly), we will put it right. We correct the registration and, where reasonable, make up for it in kind: for example by restoring a claim, stamps or credit, or by extending the term of your subscription. Tell us promptly. This is a commitment to put our own mistakes right. It is not a guarantee that Gotu always works (see section 5) and it does not affect your statutory rights.
7. Reporting illegal or incorrect content
If you see content on Gotu that you believe is illegal (for example an incorrect offer, an infringement of rights or alcohol advertising that is not allowed), report it via illegaal@gotu-app.com. Say what you see and where, and why you think it is not allowed, with your name and email address. We confirm your report, assess it carefully and let you know what we do. If we decide to remove or restrict the content, the person who posted it receives a statement of reasons and can object. This is our point of contact under the European Digital Services Act.
8. Subscriptions
Some venues offer a subscription through Gotu: for a fixed amount per 4 weeks you can claim a fixed number of non-alcoholic dishes or drinks. What is included, the price and the conditions are shown on the subscription's page. These rules also apply.
The venue sells. The venue is the seller and delivers the subscription. You reserve in the app and pay at the venue, by card or cash, when the staff enter your 4-character code. Gotu does not take payment and does not settle anything with you. Gotu is not a party to the sale of the subscription, other than providing the app in which you reserve and claim. Do you have a question or a problem with what you received? Report it in the app or at the venue.
Closed days. If the venue is closed or open differently on a day, you cannot claim anything that day. Your period does not get longer because of it and you do not get extra claims for it; whether the venue offers you something in return is for the venue to decide. This does not affect your statutory rights against the venue. If the cause is an error in Gotu's systems, section 6 applies.
Reserving and blocks. A reservation holds your spot for 24 hours. If you do not pay within that time, the reservation lapses and you are temporarily unable to reserve that subscription: 12 hours the first time, 3 months the second time and permanently the third time. If you cancel a reservation yourself, you cannot reserve that subscription again for 12 hours, without it counting as a missed payment. A block applies per subscription. The app shows you beforehand what happens if you do not pay.
Cancelling. You can cancel a subscription at any time. It then stops immediately; you do not get any money back and whatever you had not yet claimed lapses. This does not affect your statutory consumer rights.
Personal use. A subscription is personal and cannot be transferred: only you claim, from your own app. The venue may ask you for ID and sees your full name when it handles a subscription code (see the privacy policy). Misuse, such as sharing your subscription or claiming for someone else, can end your subscription without a refund.
Changes. If the venue changes the price or content of a subscription, that applies only from your next period. If the venue stops the subscription, your current period simply runs out.
9. Other
Changes. We may change these terms. For a material change we ask you to agree again in the app. If you no longer use Gotu after that, your account ends by deleting it.
Complaints. Email support@gotu-app.com. If we cannot resolve it together, you can submit the dispute to the competent court in the Netherlands. For information about out-of-court consumer dispute resolution in the EU, consult the list of European dispute-resolution bodies.
Applicable law. Dutch law applies to these terms. Mandatory consumer protection in your country of residence continues to apply.
